Limited-access, non-commercial pilot Version 1.0 | Draft dated 13 September 2026 These Terms explain the rules for using BOATARIDE, a free pilot distributed through a direct link that helps people who may be travelling in the same direction by boat discover and contact each other. They are written for the current pilot only. BOATARIDE does not provide, organise, sell or guarantee any boat journey. Important. Please read these Terms before creating an account, publishing a ride or request, or unlocking another member's details. If you do not agree, do not use those functions. 1 About BOATARIDE and these Terms BOATARIDE is a limited-access, non-commercial pilot operated by the individual identified in the Legal Notice available from the Service footer. In these Terms, “BOATARIDE”, “we”, “us” and “our” refer to that individual operator. The Legal Notice gives the operator's full legal identity, service address and contact details and forms part of these Terms. The “Service” means the BOATARIDE website or web application and the pilot functions described below. A “member” is a person with an account. A “skipper” is a member who publishes a boat journey with one or more possible places. A “seeker” is a member who publishes a request for a ride. These labels describe how a member uses the Service; they do not certify any legal status, qualification or competence. The pilot link may initially be shared within personal networks, but it may be forwarded and access is not restricted to named invitees. These Terms apply to visitors who browse the Service and to members who use account functions. Browsing results does not create a booking or a journey agreement. A binding agreement to use member functions is formed when a person actively accepts these Terms during account creation or before first using a restricted function. 2 Acceptance and privacy acknowledgement For account creation and the ability to publish, unlock or contact another member, the Service will require the following unticked checkbox: ☐ I agree to the Terms of Use and confirm that I have read the Privacy Policy. The Privacy Policy is an information notice about personal-data processing. Confirming that it has been read is not consent to every processing activity. Where consent is legally required for a specific purpose, BOATARIDE will request it separately. BOATARIDE may record the account identifier, date and time, Terms version and acceptance event so that the accepted version can be demonstrated. The Terms must remain available in a form that members can save and reproduce. 3 Eligibility - You must be at least 18 years old to create an account, publish a ride or request, unlock another member's identity or contact another member through the Service. - You must use the Service only in a private and personal capacity. Commercial passenger transport, professional charter activity and business use are not permitted in this pilot. - You must have legal capacity to accept these Terms and must not be prohibited by law from using the Service. - If a child may travel with an adult member, the child must be accompanied by a parent or legal guardian, accepted directly by the skipper, lawfully carried within the vessel's limits and insurance, and supervised by that adult at all times. A child may not hold a BOATARIDE account. 4 How the pilot works - Visitors may search by departure, destination and date and view non-identifying ride or request cards. - Search-result ride cards visible without an account may show route, date or approximate timing, boat type and indicated available places. Seeker cards may show route, date, group size and other non-identifying information. - Members may publish, edit and close a ride or request and may mark a ride as full or a request as fulfilled. - Members may unlock limited identity and journey information and use a WhatsApp or email action to contact another member directly. BOATARIDE does not provide internal chat. - BOATARIDE may send service notifications about genuinely relevant new possibilities. Notification choices and personal-data processing are described in the Privacy Policy. The pilot is free. It has no booking, payment, fare, commission, review, rating, identity-verification, skipper-verification or vessel-verification function. 5 What BOATARIDE is and is not BOATARIDE provides an online discovery and contact service. It helps users find information supplied by other users and, if they choose, contact each other directly. BOATARIDE does not operate boats, organise voyages, provide passenger transport, charter vessels, act as a carrier, travel agent, broker or booking agent, employ or appoint skippers, set routes or departure times, allocate seats, determine prices, collect money, or become a party to any arrangement between users. A search result, match label, contact action or notification is not a booking, confirmation, recommendation, endorsement or safety assessment. No user is obliged to contact another person or undertake a journey, and a skipper always remains free to change or cancel plans for safety, weather, operational or personal reasons. 6 Accounts - Provide accurate, current information and update it when it changes. - Use only your own account and keep authentication links and credentials secure. - Tell BOATARIDE promptly if you suspect unauthorised access or misuse. - Do not share another person's contact details or account information without permission. - You are responsible for activity performed through your account unless it results from a security failure for which BOATARIDE is legally responsible. 7 Rides requests and other user information You are responsible for the accuracy, legality and completeness of information you publish or provide. Information must reflect a genuine current intention and must not create a misleading impression about a person, vessel, route, timing, capacity, qualification, insurance or legal authorisation. - A skipper may publish only a journey already genuinely planned and only where the skipper has authority to use the vessel and invite the proposed number of people. - A seeker must state the correct number of people and any information reasonably relevant to safe planning, without publishing unnecessary health or other sensitive personal information. - Do not place telephone numbers, email addresses, exact meeting points, or other unnecessary personal details in fields visible without an account. - Update or close a listing promptly if plans, places or availability change. - Do not copy another person's content, identity or boat information, and do not publish anything unlawful, abusive, discriminatory, dangerous or infringing. 8 Matching and direct contact The pilot may order results using departure, destination, date, stated date flexibility and indicated capacity. It may display labels such as “Best Match”, “Could Also Work” or “Other Possibility”. Capacity shortages or imperfect route information may still produce a possible result. This ordering is an automated relevance aid, not automated safety moderation and not a decision about a person's legal rights. It does not assess identity, competence, vessel condition, insurance, route legality, weather, passenger suitability or whether a journey will occur. When a member chooses WhatsApp or email, the communication takes place through an external service subject to that service's terms and privacy practices. BOATARIDE may record that a contact button was used and when, as explained in the Privacy Policy, but does not read or control the resulting off-platform conversation. 9 User arrangements payments and commercial use Any discussion, meeting or arrangement between users is made directly between those users and outside BOATARIDE. Users decide independently whether to proceed and are solely responsible for the terms and legality of their arrangement. The pilot does not support or authorise fares, seat sales, fixed passenger prices, commissions, commercial carriage, charter services or transport offered for profit. Listings must not advertise a fare or use BOATARIDE to solicit commercial passenger business. If users independently discuss reimbursement of genuine shared voyage expenses outside the Service, these Terms do not represent that reimbursement as lawful in any particular case. It must not create profit or remuneration, must be agreed directly, and must comply with all applicable maritime, boating, tax, insurance, consumer and other rules. The vessel owner and skipper must confirm that the arrangement is permitted by law, the vessel's status and the applicable insurance. If there is any doubt, no payment should be requested or accepted. Any future BOATARIDE payment or cost-sharing function will require separate terms and will not be introduced merely by changing a label or listing field. 10 Skipper responsibilities The person in command of a vessel retains full and independent responsibility for the vessel and voyage. Before inviting or carrying anyone found through BOATARIDE, the skipper must: - have the owner's permission and every licence, qualification, registration, certificate or other authorisation required for the vessel and voyage; - ensure the vessel is seaworthy, properly maintained, legally equipped and used within its permitted navigation area, passenger capacity and operating limits; - hold and verify insurance appropriate to the vessel, route, people carried and any reimbursement arrangement, and disclose relevant limitations directly; - check weather, sea state, route, ports, local restrictions and safety conditions and change or cancel the voyage whenever prudent; - provide required safety information and equipment, comply with navigation and collision-prevention rules, and make all command and emergency decisions independently; - be fit to command and not impaired by alcohol, drugs, fatigue or another condition; and - verify directly the identity, number and reasonable suitability of those invited aboard. Nothing shown by BOATARIDE replaces official notices, charts, forecasts, navigation information, professional advice or the skipper's legal duties. 11 Seeker and passenger responsibilities A seeker or passenger decides independently whether a skipper, vessel and proposed journey are suitable. Before travelling, each adult should verify identity, route, timing, vessel information, skipper authority and qualifications where required, insurance, safety arrangements, meeting details and what to bring. - Give accurate information about group size and anything that may materially affect safe participation. - Bring required identification, clothing, medication and personal equipment agreed with the skipper. - Follow lawful safety instructions and do not interfere with navigation or vessel operation. - Do not board or remain aboard if conditions appear unsafe, capacity appears exceeded or material information is inconsistent. - Respect other people, their property, the vessel and the marine environment. 12 Safety and verification limits Boating can involve serious risks, including injury, death, delay, cancellation, weather changes, equipment failure and loss of property. Meeting a person first encountered online also involves personal-safety risks. BOATARIDE does not currently verify or certify identities, background, licences, qualifications, competence, ownership, authority to use a boat, insurance, seaworthiness, equipment, passenger capacity, routes, weather suitability or the truth of user statements. The absence of a warning or report does not mean that a person, vessel or journey is safe or lawful. Use ordinary caution, tell a trusted person about plans, meet in an appropriate place, verify material information directly and do not proceed if anything appears inconsistent or unsafe. BOATARIDE is not an emergency service. Contact the competent emergency or maritime authority in an emergency. 13 User content and licence You keep ownership of content you submit. You grant BOATARIDE a non-exclusive, worldwide, royalty-free licence, for the duration reasonably necessary to operate the pilot, to host, store, reproduce, format, display and communicate that content within the Service; create anonymous result cards and relevant notifications; and review, restrict or preserve content for security, legal compliance and dispute handling. This licence does not permit BOATARIDE to use your identity or content in external advertising without a separate lawful basis or permission. Deleted content may remain temporarily in secure backups or where retention is required by law, as explained in the Privacy Policy. You confirm that you have the rights and permissions needed for content you submit and that BOATARIDE's use of it as described above will not infringe another person's rights. 14 Prohibited use You must not use the Service to: - offer or promote unlawful, unauthorised or commercial passenger transport, charter, brokerage or another regulated service; - request or advertise a fare, fixed seat price, commission or profit-making payment; - mislead, impersonate, defraud, harass, threaten, discriminate against or endanger another person; - publish illegal content or content that violates privacy, confidentiality, intellectual property or other rights; - publish another person's contact details or sensitive information without a lawful basis and permission; - spam, scrape, harvest data, build a competing database or use contact access for unrelated solicitation; - introduce malware, probe security, bypass access controls, reverse engineer the Service where prohibited, or interfere with its operation; - create multiple or false accounts, manipulate results, evade a restriction or misuse reporting tools; or - encourage or assist any of the above. 15 Reports moderation and account restrictions BOATARIDE may review content manually after a report or on its own initiative. The current pilot does not use automated tools to decide whether content is illegal or violates these Terms. Automated match ordering described in Section 8 is not content moderation. BOATARIDE may reduce visibility, remove or disable content, restrict a function, suspend an account or terminate access where reasonably necessary because of illegality, a breach of these Terms, fraud, safety risk, security risk, repeated misuse, a legal order or protection of another person's rights. Decisions will be taken as diligently, objectively and proportionately as reasonably possible, considering the available facts and affected rights. The Service will provide an electronic route to report specific allegedly illegal content. A notice should identify the exact listing or location, explain why it is alleged to be illegal, include available supporting information, provide the notifier's name and email unless an applicable legal exception permits otherwise, and confirm a good-faith belief that the notice is accurate and complete. Where contact details are available and the law permits, BOATARIDE will acknowledge a sufficiently complete notice and communicate its decision. When BOATARIDE restricts a member's content or account because it considers it illegal or incompatible with these Terms, it will provide a clear reason and available review options unless doing so is prohibited by law, would create a serious security or safety risk, or concerns deceptive high-volume commercial content. A member or notifier may request human review through the contact route in the Legal Notice. BOATARIDE may temporarily restrict manifestly abusive or repeated unfounded reports after warning where appropriate. 16 Pilot availability changes and closure BOATARIDE is an early-stage free pilot. Functions may contain errors or be unavailable. BOATARIDE may maintain, modify, limit, pause or end part or all of the pilot. Where a change materially reduces an existing member's access, reasonable notice will be given when practicable. Immediate action may be taken for security, safety, legal, technical or abuse-prevention reasons. BOATARIDE does not promise uninterrupted availability, a minimum number of users or journeys, a successful match, a response from another member, preservation of a listing forever, or continuation of the pilot. Mandatory rights and liability that cannot lawfully be limited remain unaffected. 17 Ending your account and withdrawal You may stop using BOATARIDE at any time, close active listings and request account deletion through My BOATARIDE or the contact route in the Legal Notice. Account deletion ends your right to use member functions and normally removes active listings from results. Personal-data deletion and any necessary retention are governed by the Privacy Policy and applicable law. If a mandatory statutory right to withdraw from the agreement applies, you may exercise it without giving a reason or paying a charge by deleting the account or sending an unequivocal withdrawal statement through the published contact route. A model statement is: “I withdraw from my BOATARIDE user agreement.” Include the account name or email needed to identify the account and, if known, the acceptance date. Sections that by their nature must continue after account closure, including provisions on existing user arrangements, intellectual property, responsibility, disputes and lawful retention, will continue to apply. 18 Responsibility and liability Each user is responsible for that user's own conduct, content, decisions, vessel, voyage and arrangements with other users. BOATARIDE is not responsible for performing a journey or for an independent user's act or omission merely because the users first discovered each other through the Service. To the extent permitted by law, BOATARIDE is not liable for a journey's cancellation, delay, route, condition or outcome; a vessel's condition or equipment; a user's identity, competence, insurance or conduct; or loss caused by inaccurate user information, weather, sea conditions, port restrictions, external communications services or another circumstance outside BOATARIDE's reasonable control. BOATARIDE remains responsible for loss directly caused by its own breach where applicable law imposes that responsibility. Nothing in these Terms excludes or limits liability for fraud or wilful misconduct, gross negligence, death or personal injury caused by BOATARIDE where liability cannot lawfully be excluded, breach of data-protection duties, infringement of mandatory digital-services obligations, or any other liability or remedy that applicable law does not permit to be excluded or limited. These Terms allocate responsibility according to the actual role of the pilot; they do not require a consumer to indemnify BOATARIDE and do not waive mandatory consumer rights. 19 Privacy and essential technologies The Privacy Policy explains how BOATARIDE processes personal data and how rights can be exercised. It is provided as an information notice and is not incorporated as blanket consent. The pilot may use only technical cookies or similar storage strictly necessary for authentication, security, session continuity and operation. Details belong in the Essential Technologies Notice. Advertising or profiling technologies must not be introduced without first updating the legal and consent architecture where required. 20 Complaints and contact The Legal Notice identifies the individual operator and provides the current electronic contact route for account questions, complaints, content reports, legal notices and communications from authorities. It also states the languages accepted for contact. Please identify the relevant account or listing and explain the issue clearly. BOATARIDE will aim to respond within a reasonable time, taking account of urgency, safety and legal obligations. Nothing prevents either party from using a competent authority, court or mandatory redress route. 21 Changes to these Terms BOATARIDE may update these Terms to reflect legal requirements, safety measures, abuse risks or changes to the pilot. Significant changes will be communicated to affected members in advance where reasonably possible. If a change materially alters the agreement, BOATARIDE will request renewed acceptance before continued use of the affected member functions where required. Urgent changes required by law, security or safety may take effect sooner. The Service will identify the current version and effective date. Continued anonymous browsing after a change does not replace renewed express acceptance where the law or the nature of the change requires it. 22 Applicable law and disputes These Terms are governed by Italian law. This choice does not deprive a consumer of mandatory protections that apply under the law of the consumer's habitual residence. The competent court is determined by mandatory law. In particular, where consumer-jurisdiction rules apply, a consumer may bring proceedings in the courts available under those rules and may be sued only where those rules permit. These Terms do not impose an exclusive forum that overrides a consumer's mandatory rights. Before starting formal proceedings, users are invited, but not required, to contact BOATARIDE so that the issue can be understood and a practical solution considered. 23 Final provisions If any provision is found invalid or unenforceable, the remaining provisions continue to apply, and the affected provision will apply only to the maximum lawful extent. A failure to enforce a provision once is not a waiver of the right to enforce it later. These Terms, together with the Legal Notice and any specific rules expressly presented for a pilot function, form the agreement for use of BOATARIDE. They do not govern the separate arrangements users may make with one another. If BOATARIDE later introduces payments, business users, professional transport, verification, ratings, internal messaging or materially different services, revised terms and legal review will be required before those functions launch.
